The short answer

If another party's carelessness or a defective product caused your amputation, California law may allow you to seek compensation for lifetime medical care, prosthetics and replacements, lost earning capacity, and pain. Workers' compensation does not necessarily bar a separate claim against a third party. Most lawsuits must be filed within two years.

Losing a limb, a hand, a foot, or a finger is one of the most life-changing injuries a person can suffer. Some amputations happen at the scene of a crash or a workplace accident. Others happen in the hospital, when surgeons must amputate after a crush injury, a severe fracture, or a loss of blood flow that cannot be repaired. Either way, the person and the family face a long road of surgeries, rehabilitation, adjusting to a new way of living, and costs that continue for decades.

The practical needs after an amputation are large. They can include a prosthetic limb that must be fitted, adjusted, and replaced over a lifetime, physical and occupational therapy, pain management for residual limb pain and phantom pain, mental health support, changes to a home or vehicle, and sometimes retraining for a new kind of work. A life care plan prepared with medical professionals can help show what a person is likely to need over the years ahead.

Our founding attorneys spent years on the insurance defense side and inside a major auto insurer, so we know how insurers approach serious injury claims. In our experience, they tend to underestimate lifetime prosthetic and replacement costs, treat the first prosthetic as the end of the story, and underweight the emotional and psychological toll. We build the claim around the person's whole future.

Your consultation is free and confidential, and you pay no attorney's fee unless we recover compensation for you. This page describes the injury and how claims for it are fought and valued, regardless of how it happened, whether in a crash, a workplace accident, a machinery incident, or another event. Please call us early so we can help protect the evidence.

From the other side of the table

How insurers underestimate amputation claims

01

Underestimating lifetime prosthetic costs

Prosthetics wear out, sockets need refitting, and technology changes. Insurers often price a single device and move on. We work with prosthetists, physicians, and life care planners to account for replacements and upgrades over a lifetime.

02

The quick, early offer

Soon after a serious injury, the full picture is not yet clear, including how well you adapt, what complications arise, and what work you can return to. Early offers tend to reflect the insurer's interests, not your future. We help you avoid settling before the needs are understood.

03

Surveillance and adaptation arguments

Insurers may watch for evidence that you are doing well, then argue you have adapted and need little help. A good day on camera does not capture pain, fatigue, and limits. We prepare clients and explain the whole picture.

04

Discounting the human cost

Phantom pain, body image, anxiety, depression, and the loss of independence are real, but may be minimized in a negotiation. We document them with providers and with the people who see them every day.

Why it happens

Common causes

Vehicle and motorcycle crashes

High-force collisions can crush or sever limbs at the scene or leave injuries so severe that surgeons must amputate.

Pedestrian and bicycle impacts

A person struck by a vehicle can suffer devastating leg and foot injuries that lead to amputation.

Industrial machinery and equipment

Presses, saws, conveyors, and other equipment can crush or sever limbs, especially when guards, safety features, or training are missing.

Defective products

A product with a design or manufacturing defect, or without adequate warnings, may be responsible when it causes a traumatic injury.

Construction and workplace accidents

Falls, struck-by incidents, and heavy equipment accidents at job sites can cause crush injuries and amputations.

Medical complications after a severe injury

Crush injuries, infection, or loss of blood flow after trauma can make a later surgical amputation necessary, and the original at-fault party may still be responsible for the harm.

What we see

Injuries we handle

Traumatic amputation of an arm, hand, or fingers
Traumatic amputation of a leg, foot, or toes
Surgical amputation after a crush injury
Partial limb loss and degloving injuries
Severe nerve and blood vessel damage
Phantom limb pain and residual limb pain
Infections and complications of the surgical site
Depression, anxiety, and post-traumatic stress after limb loss

What you may recover

Compensation in a California claim

Medical expenses, past and future

Emergency care, surgeries, hospital stays, rehabilitation, and ongoing medical care, including follow-up procedures and complications.

Prosthetics, replacements, and equipment

The cost of prosthetic limbs, fittings, repairs, and replacements over a lifetime, along with mobility equipment and supplies.

Home and vehicle modifications

Changes such as ramps, bathroom modifications, and adapted vehicle controls that help a person live and move safely.

Lost income and vocational retraining

Wages lost during recovery, reduced earning capacity, and the cost of retraining for work a person can do after limb loss.

Mental health care

Counseling and treatment for depression, anxiety, and trauma that often accompany limb loss.

Pain, suffering, and loss of enjoyment of life

Physical pain including phantom pain, emotional distress, scarring, and the loss of activities and independence.

The rules that apply

California law you should know

Two-year filing deadline

Most personal injury lawsuits in California must be filed within two years of the injury. Machinery and product evidence can be lost much sooner.

Code of Civil Procedure § 335.1

Product defect claims

A product may be considered defective in design if it fails to perform as safely as an ordinary consumer would expect, or if the risks of the design outweigh its benefits. Courts apply this test in machinery and equipment cases.

Barker v. Lull Engineering Co. (1978) 20 Cal.3d 413

Workplace amputations and third parties

An employee who is injured at work may be limited to workers' compensation against the employer, but may generally also bring a separate claim against a third party, such as an equipment manufacturer or property owner.

Labor Code § 3852

Past medical damages

Past medical expenses are generally limited to the amounts actually paid or incurred, rather than the full amount billed.

Howell v. Hamilton Meats & Provisions, Inc. (2011) 52 Cal.4th 541

Shared responsibility among multiple parties

Where several parties contributed to an injury, and where an insurer argues you share some blame, compensation is generally apportioned by percentage of fault rather than barred entirely.

Li v. Yellow Cab Co. (1975) 13 Cal.3d 804

Government claims

If a public agency or public property may be involved, a government claim generally has to be presented within six months.

Government Code § 911.2

Protect your claim

Evidence to gather

  • Medical records from the scene, the emergency room, and every surgery
  • Prosthetist evaluations, fitting records, and recommended device plans
  • Photos of the scene, the machinery or product, and your injuries
  • The machinery, tool, vehicle, or product itself, kept unaltered and unrepaired
  • Maintenance records, safety manuals, and training records for equipment
  • Police, CHP, OSHA, or incident report numbers, if any
  • Names and contact information for witnesses and co-workers
  • Pay records, job descriptions, and notes on how limb loss affects your work and daily life

Mistakes insurers count on

  • Settling early before the lifetime needs are understood
  • Giving a recorded statement or signing forms for an insurance company
  • Allowing the machine, vehicle, or product to be repaired, discarded, or returned to the manufacturer
  • Assuming workers' compensation is the only claim available after a workplace accident
  • Posting about activities or recovery on social media that could be misunderstood
  • Skipping mental health support when it is offered

Step by step

How we handle your case

  1. 1

    Protect the evidence quickly

We send preservation demands for machinery, vehicles, product samples, and records so critical evidence is not repaired, discarded, or altered.

  2. 2

    Identify every responsible party

We look at drivers, employers, property owners, equipment makers, product manufacturers, and others who may share responsibility.

  3. 3

    Build a life care plan

Working with physicians, prosthetists, therapists, and other professionals, we help document the medical, equipment, and support needs you are likely to have over the long term.

  4. 4

    Measure financial losses

Where appropriate, vocational experts and economists help show the effect on your earning capacity and the real cost of lifetime care.

  5. 5

    Handle the insurers

We take over communications with insurers so you can focus on recovery, and we avoid early settlements that do not reflect your future needs.

  6. 6

    Negotiate or try the case

We negotiate for compensation that reflects the whole picture, and we file suit within the deadline and prepare for trial when needed.
