The short answer

Bedsores (pressure ulcers) in a California nursing home are often evidence of neglect. Victims can recover compensation for medical care, pain and suffering, and wrongful death. You generally have two years to file (CCP § 335.1). Document the wounds and consult a lawyer immediately.

Bedsores, also called pressure ulcers or pressure injuries, develop when constant pressure cuts off blood flow to the skin and tissue, usually over bony areas like the tailbone, hips, heels, and shoulder blades. For residents who cannot move on their own, prevention depends almost entirely on the staff: regular repositioning, pressure-relieving mattresses, good nutrition and hydration, clean and dry skin, and daily skin checks. When those basics are missed, a small red patch can progress to a deep wound that exposes muscle or bone.

Advanced bedsores are painful and dangerous. They can lead to bone infections, sepsis, amputations, and death. For families, discovering a serious wound on a parent or spouse, often only after a hospital transfer, can be shocking, especially when the facility never mentioned it. Many residents in skilled nursing facilities across Los Angeles County rely completely on staff to prevent these injuries.

Our founding attorneys previously defended claims for insurers, including in-house at a major insurance company. We know the standard defense: the wound was clinically unavoidable because of the resident's diagnoses. Sometimes that is true. Often, it is not. We look closely at skin assessments, turning schedules, nutrition records, staffing levels, and wound documentation to determine whether the facility did what federal and California standards require, and whether the records are consistent with each other.

If your loved one developed a bedsore in a nursing home, hospital, or assisted living facility, we can review what happened. Families often call after a hospital nurse or doctor raises concerns about a wound. Bring whatever you have, such as photos, discharge papers, or notes, and we will explain what the records may show and what options may be available to you. Consultations are free, and you pay no attorney's fee unless we recover compensation for you.

From the other side of the table

How the insurer's adjuster sees your claim

01

The unavoidable wound argument

Defense teams often argue that a resident's diabetes, poor circulation, or end-stage illness made a pressure injury inevitable. Federal regulations require facilities to prevent pressure ulcers unless the resident's clinical condition shows they were unavoidable, so the question becomes whether the facility actually took every required preventive step.

02

Turning logs that look too perfect

Repositioning records filled in identically every two hours, including during short-staffed shifts, can raise questions. We compare them with staffing schedules and timecards to test whether the documented care could realistically have been provided.

03

Staging disputes

Insurers value claims partly by how severe the wound was and when it was first noticed. Late or inaccurate staging can hide how long a wound was developing. We review photos, hospital records, and wound notes to establish a timeline.

04

Linking the wound to later harm

When a resident develops sepsis or dies, the defense may attribute it to unrelated causes. We work with physicians to trace whether the pressure injury contributed to infection, hospitalization, or death.

Why it happens

Common causes

Failure to reposition

Residents who cannot move on their own need to be turned and repositioned regularly. Missed turns are one of the most common causes of pressure injuries.

Missing or inadequate risk assessments

Facilities should assess each resident's risk for pressure injuries on admission and after changes in condition, then build prevention into the care plan.

Lack of pressure-relieving equipment

Specialty mattresses, cushions, and heel protectors help redistribute pressure. Failing to provide or maintain them can allow wounds to form.

Poor incontinence care

Leaving residents in wet or soiled briefs damages the skin and makes it far more vulnerable to breakdown and infection.

Malnutrition and dehydration

Skin and tissue need adequate protein, calories, and fluids to stay healthy and heal. Residents who are not helped with meals are at higher risk.

Delayed wound treatment and physician notification

When early-stage wounds are not reported, treated, or monitored, they can quickly worsen into deep, infected ulcers.

What we see

Injuries we handle

Stage 1 and Stage 2 pressure injuries with skin damage and blistering
Stage 3 pressure ulcers with full-thickness tissue loss
Stage 4 pressure ulcers exposing muscle, tendon, or bone
Unstageable wounds and deep tissue pressure injuries
Osteomyelitis (bone infection)
Cellulitis and wound infections
Sepsis originating from an infected wound
Surgical debridement, skin flaps, or amputation

What you may recover

Compensation in a California claim

Medical and wound care costs

Hospitalization, surgical debridement, wound vacuum therapy, antibiotics, specialty beds, and ongoing wound care.

Pain and suffering

Advanced bedsores can be intensely painful. Residents may recover for the pain, discomfort, and emotional distress the wound caused.

Loss of dignity and quality of life

Compensation for the humiliation, isolation, and loss of function that often accompany severe pressure injuries.

Elder Abuse Act remedies

When the failure to prevent or treat a bedsore rises to reckless neglect, proven by clear and convincing evidence, the Elder Abuse Act allows recovery of attorney's fees and costs and relaxes certain damage limits.

Wrongful death damages

If a pressure injury leads to a fatal infection, surviving family members may bring a wrongful death claim, and the estate may pursue a survival action.

The rules that apply

California law you should know

Federal pressure ulcer prevention standards

Nursing homes participating in Medicare and Medicaid must provide care that prevents pressure ulcers unless they are clinically unavoidable, and must provide treatment to promote healing and prevent infection.

42 C.F.R. Part 483

Neglect under the Elder Abuse Act

Neglect, including failing to assist with personal hygiene, provide medical care for physical needs, or protect from health and safety hazards, is a form of abuse under California law.

Cal. Welf. & Inst. Code §§ 15600 et seq., 15610.07

Enhanced remedies for reckless neglect

Where recklessness, oppression, fraud, or malice is proven by clear and convincing evidence, the court may award attorney's fees and costs.

Cal. Welf. & Inst. Code § 15657

Residents' rights violations

Skilled nursing facility residents may sue for violations of their rights and recover up to $500 per violation, plus attorney's fees and costs.

Evidence to gather

  • Dated photographs of the wound and surrounding skin
  • Hospital admission records describing the wound's stage and size
  • The facility's skin assessments and wound care notes
  • Turning and repositioning logs
  • Nutrition, weight, and fluid intake records
  • Care plans and any updates after the wound appeared
  • Notes of what staff told you and when
  • Records of mattresses, cushions, and equipment provided

Mistakes insurers count on

  • Assuming a bedsore is a normal part of aging or illness
  • Waiting for the facility to explain a wound rather than requesting records
  • Not photographing the wound when you are able to do so respectfully
  • Leaving your loved one in a facility where the wound keeps worsening without a plan
  • Delaying legal review until after deadlines have become a concern

Step by step

How we handle your case

  1. 1

    Listen and review

We learn how and when the wound was discovered and what the facility told your family, then explain your options.

  2. 2

    Obtain the full record

We request skin assessments, care plans, turning logs, nutrition records, wound notes, and hospital records.

  3. 3

    Build the timeline

With nursing and medical reviewers, we reconstruct when the wound began, how it progressed, and what the facility did at each stage.

  4. 4

    Test the documentation

We compare the chart against staffing data and other records to identify gaps between documented care and delivered care.

  5. 5

    Pursue the claim

We present the claim under the most appropriate legal theories and are prepared to file suit if the facility and its insurer do not respond fairly.

Frequently asked questions

Not always. Some residents are so medically fragile that a pressure injury may develop despite appropriate care. But many bedsores, particularly Stage 3 and Stage 4 wounds, develop because basic prevention like repositioning, nutrition, and skin checks was not provided consistently. Determining which applies requires a careful review of the records by people who understand nursing standards.

Stages of Bedsores: When You Should Call a Lawyer

Bedsores worsen in stages. The more severe the stage, the longer neglect may have occurred — and the stronger your legal claim.

"By the time a bedsore reaches Stage 3 or Stage 4, it often means the problem was ignored for days or even weeks. They usually happen because nursing facilities fail to provide adequate care rather than due to unavoidable medical issues. These severe bedsores are considered "never events," meaning they should not happen if the facility follows proper care standards."

👉 If your loved one has a Stage 2 or higher bedsore, you should speak with a lawyer immediately.
